Testimonial Terms & Conditions
By submitting a testimonial to Exclusivité Skin (“we,” “us,” “our”), you agree to the following terms and conditions. These terms apply to all submissions from any location including the United States and Canada.
1. Eligibility and Accuracy
You confirm that all information you submit is truthful, complete, and your own original work. This includes your name, credentials, testimonial text, photos, videos, ratings, and any other content you provide.
You confirm that any credentials you list, including professional titles or qualifications, are accurate and not misrepresented.
You confirm that any before and after photos reflect your real results without digital alteration. Filters, AI modifications, retouching, or enhancements are not permitted. Photos must be taken in consistent lighting, angles, and conditions.
You confirm that you are at least 18 years of age, or that you are a parent or legal guardian submitting content on behalf of someone under 18.
If the individual featured in the testimonial, photos, or videos is under 18, the testimonial must be submitted by a parent or legal guardian. The parent or legal guardian must confirm that they understand and agree to these Terms and accept full responsibility for the testimonial content submitted on behalf of the minor.
2. Consent to Use
You grant Exclusivité Skin a perpetual, worldwide, royalty free, irrevocable, and non exclusive license to use, reproduce, edit, publish, adapt, translate, distribute, and display your testimonial. This includes any text, images, videos, and personal identifiers you choose to provide.
This license applies to all digital and physical platforms including websites, social media, email communications, print materials, advertising, and promotional campaigns.
We may crop, resize, edit grammar or clarity, format, caption, or adapt your content while preserving its original meaning.
3. Personal Information
Your personal information will be used only in connection with your testimonial and according to our Privacy Policy. You may request that your name or identifying details be removed or anonymized at any time.
4. No Compensation and No Obligation
Unless clearly stated on the submission page, you confirm that you have not received payment for your testimonial.
You understand that small gifts such as samples, discount codes, or store credit do not constitute compensation.
You understand that you will not receive any additional compensation for future use of your testimonial.
5. No Confidential or Third-Party Information
You confirm that your submission does not contain confidential information or content owned by a third party.
You confirm that the publication of your testimonial will not violate the rights of any individual or organization.
6. Privacy and Data Use
Your use of our submission form is governed by our Privacy Policy. This policy explains how your information is collected, used, stored, and protected.
7. Indemnification
You agree to indemnify and hold harmless Exclusivité Skin and its affiliates from any claims, losses, damages, or legal expenses related to your testimonial. This includes claims involving intellectual property, inaccurate statements, privacy concerns, or regulatory inquiries related to your content.
8. Review and Compliance
You acknowledge that any medical, cosmetic, or device related claims included in your testimonial may be reviewed for regulatory compliance before publication.
You acknowledge that individual results vary and that your experience does not guarantee similar outcomes for others.
9. Limitations of Liability
If a dispute arises related to your testimonial, your only remedy is to request removal of the testimonial from our materials.
We are not responsible for indirect, special, or incidental damages arising from your submission or its use.
10. Removal and Withdrawal
We may accept, reject, edit, or remove testimonials at our discretion and without notice.
You may request removal of your testimonial at any time. We will remove it from our platforms promptly, but we cannot guarantee removal from third party platforms, archived content, previously distributed materials, or user generated reposts.
11. Public Disclosure
You understand that once approved, your testimonial may be publicly accessible. We are not responsible for screenshots, shares, or further distribution by others.
12. Governing Law
These terms are governed by the laws of the United States and Canada.
Where legally permissible, disputes will be resolved under the laws of the State of Florida, USA or the laws of the Province of Ontario, Canada, at our discretion.
We may determine the appropriate jurisdiction based on the parties involved and the nature of the claim.
13. Changes to These Terms
We may update or revise these terms at any time. The version in effect at the time of your submission will apply to your testimonial.
